60 Days Notice To Vacate or Terminate Required

Beginning January 1, 2007, California Civil Code § 1946.1 requires residential landlords to provide a written sixty (60) days notice to end a month-to-month, or other periodic, residential tenancy, so long as all of the tenants have resided on the property for one year or more. In those instances where a tenant has been residing on the property for less than one year, then thirty (30) days written notice is still sufficient.

The California legislature did provide one additional exception…thirty (30) days written notice will be sufficient if all of the following conditions are met:

  1. the dwelling unit is a separately alienable unit (e.g. single family residence, condominium, or townhouse, but not a duplex, triplex or other multi-unit property);
  2. the landlord sold the dwelling unit to a bona fide purchaser for value;
  3. the buyer is a natural person or persons;
  4. the buyer intends to live in the property for at least one full year; and
  5. the landlord provided the tenant(s) with 120 days written notice after escrow opened.

Tenants, however, are still only required to provide their landlord with Thirty (30) days written notice of their intent to vacate.
