CA Landlords Must Now Install Carbon Monoxide Detectors

The Carbon Monoxide Poisoning Prevention Act of 2010 requires all single family dwellings that have either (1) a fossil fuel-burning heater, appliance or fireplace (e.g., a gas stove or water heater) or (2) an attached garage to have an approved carbon monoxide alarm installed outside the bedrooms but in their immediate vicinity (e.g. hallway), and an additional carbon monoxide alarm on each level of the home including the basement (if any).

To be approved, the carbon monoxide alarm must be certified. The California Fire Marshal’s web site maintains a list of approved carbon monoxide alarms (PDF).

Although failure to install the carbon monoxide alarms may result in a maximum civil fine of only $200, the new requirement will create a presumption of negligence in any case where an individual, pet, or other property is injured as a result of a carbon monoxide leak where no carbon monoxide detectors were present.

The new law also sets forth how the carbon monoxide alarms are to be maintained in rental units. Pursuant to California Health & Safety Code Section 17926.1:

  1. The carbon monoxide alarm must be in working order when a tenant takes possession of the dwelling unit;
  2. the owner/landlord is required to maintain the alarm and may enter the premises to install, repair, test, and maintain the alarm upon 24 hours prior written notice; and
  3. the tenant is required to notify the owner/landlord of any known operational deficiencies with respect to the installed alarms.
All single family dwellings are required to comply with this new law on or before July 1, 2011. All multi-unit dwellings are required to be in compliance on or before July 1, 2013.
