Mayor Eric Garcetti and Councilmember Gil Cedillo have essentially ordered the Los Angeles Housing and Community Investment Department (HCID) and all other city offices to improve enforcement of the Ellis Act. The Ellis Act, passed in 1985, allows properties subject to a rent stabilization ordinance to be removed from the rental market under specified conditions. Effective immediately HCID will not just review the demolition permits and plans to remove a rent controlled property from the housing market, but now will scrutinize the permits for a full 5-year period after the property has been withdrawn to ensure it has not been re-rented, or rebuilt. Why? Because the Los Angeles Rent Stabilization Ordinance requires that rental properties removed from the rental market through the Ellis Act provide low income housing at specified affordability levels if they are re-rented, or rebuilt, within 5 years. Proceed with caution.
